Terms and Conditions
These terms apply to every Book & Tip booking and every visit to tip waste at Clayton Hall MRF.
Contents
1. About these terms
These terms apply to every Book & Tip booking and every visit to tip waste at Clayton Hall MRF. By making a booking, arriving to tip, or opening an account, you accept them.
1.1 Who we are. Book & Tip is provided by Everwaste MRF Ltd, a company registered in England and Wales (company no. 16737262), registered office 5 Mitchell Court, Castle Mound Way, CV23 0UY ("we", "us"). We take all bookings, deposits and payments and issue all invoices.
1.2 The site and its permit. Waste is received and treated at Clayton Hall MRF, Clayton Hall Sand Quarry, Dawson Lane, Whittle-le-Woods, Chorley PR6 7DT ("the Site"). The Site operates under environmental permit EPR/AP3897CJ, held by Quercia Limited. Everwaste MRF Ltd and Quercia Limited are under common ownership. Where these terms refer to what the permit allows, they mean permit EPR/AP3897CJ as in force at the time of your visit.
1.3 Business customers only. Book & Tip is a service for businesses. It is not available to consumers or householders.
1.4 Definitions.
- Booking: a reserved slot to tip one load from one vehicle.
- Deposit: the £20 (including VAT) paid when you book.
- Customer or you: the business named on the booking, and anyone acting for it, including its drivers.
- Load: the waste carried in one skip or one van for one booking.
- Accepted Waste: waste listed as accepted on our website for Book & Tip, and permitted by the permit.
- Non-conforming Waste: any waste that is not Accepted Waste, or that doesn't match the waste declared at booking or on the transfer note.
- Transfer Note: the waste transfer note required by the duty of care for the Load.
- Account: a pre-paid Book & Tip account.
1.5 Order of precedence. If anything on our website, in a confirmation email or said by staff conflicts with these terms, these terms apply unless we agree otherwise in writing.
2. Who can use Book & Tip
2.1 Carrier registration. You must hold a valid waste carrier, broker or dealer registration with the Environment Agency (or the equivalent UK regulator), in the name of the business making the booking. We check it when you book and may check it again on arrival. If it isn't valid, current and in your business's name, we won't accept the booking or let you tip.
2.2 Accepted skips and vehicles. We only accept waste brought:
- in a 2, 4 or 8 yard skip on a skip loader; or
- in a van: a goods vehicle up to 3.5 tonnes gross (category N1 on its registration document, V5C).
We don't accept larger skips, roll-on/roll-off or hook-loader containers, grab lorries, tippers, trailers of any kind, or passenger cars (M1). Vehicles must be within the Site's weight and size limits, roadworthy, and have the load sheeted or covered on arrival.
2.3 One vehicle per booking. Each booking covers one vehicle and one Load. Book a separate slot for each vehicle or each extra visit.
2.4 Your information. You must give accurate details when booking: company name and number, carrier registration, contact details, vehicle registration, skip size or vehicle type, and a description of the Load. You are responsible for anyone who books or visits on your behalf.
3. Bookings, deposit and cancellations
3.1 Making a booking. Bookings are made online. If you book by phone or email, we will send you a payment link for the deposit. We hold the slot for 2 hours. If the deposit isn't paid in that time, we release the slot.
3.2 Confirmation. A booking is confirmed only when the deposit is paid and your carrier registration has passed our check. We'll email you a confirmation with your slot, reference and what to bring.
3.3 Opening hours. Slots run Monday to Friday 9:00–16:00 (last slot 15:40). We are closed on Saturdays, Sundays and bank holidays. We may change opening hours with notice on our website.
3.4 The deposit. The deposit is £20 including VAT. It is deducted from the charge for your visit. It is not a separate fee unless it is kept under clause 3.6.
3.5 Cancelling. You can cancel from the link in your confirmation email, or by emailing us with your booking reference.
- Cancel 24 hours or more before your slot and we'll refund the deposit in full to the card you paid with.
- Cancel less than 24 hours before your slot and the deposit is kept.
3.6 When we keep the deposit. We keep the deposit if:
- you cancel less than 24 hours before your slot;
- you don't arrive and haven't told us you're running late;
- we refuse entry because your carrier registration, transfer note or vehicle doesn't meet these terms;
- we refuse your Load at the gate because it contains Non-conforming Waste; or
- we stop your visit for a breach of the site rules.
3.7 Running late. If you tell us before your slot that you're running late, we'll try to fit you into the next free slot that day. We can't guarantee one. If we fit you in, your deposit is used as normal.
3.8 Changing a booking. To change your slot, cancel and rebook. The 24-hour rule in clause 3.5 applies to the original booking. If you need to send a different vehicle, tell us or tell staff at the gate. We'll update the booking if the vehicle meets clause 2.2.
3.9 If we cancel. If we close the Site or can't take your booking, for example because of bad weather, a breakdown, an emergency or capacity, we'll tell you as soon as we can and refund your deposit in full. We aren't liable for any other costs this causes you.
4. Arriving on site
4.1 Walk-ins. You may arrive without a booking. We'll give you the next free slot that day, if there is one. Booked customers always take priority. No deposit is taken for a walk-in, and all other terms apply.
4.2 Capacity. We may hold vehicles at the gate, or turn them away, if the Site is full or it isn't safe to admit more vehicles. If you had a booking and we can't admit you, we'll refund your deposit.
4.3 Transfer note. Every Load must come with a completed, signed Transfer Note that accurately describes the waste, gives its EWC code and quantity, and gives the producer and carrier details. The receiving site must be named as:
Quercia Limited, Clayton Hall MRF, Clayton Hall Sand Quarry, Dawson Lane, Whittle-le-Woods, Chorley PR6 7DT
We don't write or complete transfer notes for you. If your note is missing, incomplete or names the wrong receiving site, you must correct it before you tip. If you can't, we'll refuse the Load. We keep a copy of every Transfer Note.
4.4 Gate checks. Before you tip, we check your booking, vehicle, carrier registration and Transfer Note, and look at the Load. You must follow staff instructions throughout your visit.
4.5 Our records. We record every Load we receive, and report it to the government's digital waste tracking service as the law requires. By booking, you agree that we may share the information needed for this.
5. Your waste
5.1 Accepted Waste. We accept mixed, non-hazardous commercial, construction and demolition waste as listed on the "What we accept" page of our website. That page, and the full permitted list, form part of these terms. A waste type that isn't on the permit is never accepted.
5.2 Waste we don't accept. We don't accept, among other things: hazardous waste of any kind, asbestos, soil and stones, plasterboard, tyres, hazardous treated wood, fridges, freezers, TVs and monitors, other electrical items, fluorescent tubes, paint, oils, solvents and chemicals, gas bottles and cylinders, batteries and vapes, sofas and upholstered furniture, green and garden waste, food waste, liquids and sludges, and clinical waste.
5.3 Plasterboard. We don't accept plasterboard, for health and safety reasons. A Load containing plasterboard is Non-conforming Waste.
5.4 Your declaration. When you book, you confirm that your description of the Load is accurate, that it contains no hazardous or Non-conforming Waste, and that you hold a valid carrier registration. You are responsible for knowing what is in your Load, including waste collected from your own customers.
5.5 Non-conforming Waste found at the gate. We will refuse the Load and keep your deposit.
5.6 Non-conforming Waste found while tipping. You must reload it onto your vehicle before you weigh out, so you aren't charged for it. If you can't or won't reload it, we'll treat it as found after you left (clause 5.7).
5.7 Non-conforming Waste found after you leave. We'll quarantine and photograph it and arrange its lawful removal. We'll invoice you for the cost of removal, transport, disposal and handling, plus a reasonable admin charge. The invoice is payable within 14 days.
5.8 Hazardous waste. If your Load contains hazardous waste, such as asbestos, we'll stop tipping in the affected area and follow our emergency procedures. We may notify the Environment Agency. You must pay all the costs this causes, including containment, testing, specialist removal, disposal and lost operating time.
5.9 Ownership. Waste remains yours, and your responsibility, until it has been weighed out, paid for and accepted by us. Non-conforming Waste remains yours at all times.
5.10 Mixed loads. All Accepted Waste is charged at the same rate, however mixed. We don't sort or separate waste for you before tipping.
6. Weighing, charges and payment
6.1 Weighing. Your vehicle is weighed in before tipping and weighed out after, on our certified weighbridge. The net weight is the difference, and it is shown on the tickets we give you. The weights on those tickets are final.
6.2 Price. The charge is £165 plus VAT per tonne of net weight, with a minimum charge of 0.5 tonne per Load. We may change the price for future bookings with notice on our website. The price at the time you book applies to that booking.
6.3 Paying. Your deposit, or account credit, is deducted first. You then pay the balance by card on the weighbridge before you leave. We don't accept cash, and we don't offer credit terms.
6.4 If your card is declined. You may pay the balance by bank transfer while on site. We'll confirm receipt before you leave.
6.5 If you don't pay. If you can't or won't pay, including because you dispute the weight, you must reload your waste onto your vehicle and remove it from the Site. You remain responsible for any costs we incur as a result. We may refuse you further bookings (clause 9.1).
6.6 Invoices. We'll email a VAT invoice from Everwaste MRF Ltd to your booking email address. Charges under clauses 5.7 and 5.8 are invoiced separately and payable within 14 days. We may charge interest on late payments under the Late Payment of Commercial Debts (Interest) Act 1998. We won't accept further bookings while an invoice is unpaid.
7. Pre-paid accounts
7.1 Opening an account. Accounts are for regular customers. To open one, you must buy at least £1,000 of credit.
7.2 Top-ups. Each top-up is £1,000 minimum.
7.3 Using credit. The charge for each visit is deducted from your credit at weigh-out. If your balance doesn't cover the charge, you pay the difference by card on the weighbridge. Your balance can't go below zero, and accounts don't come with credit terms.
7.4 Deposits still apply. The £20 deposit still applies to each booking made on an account, unless we tell you in writing that it's waived.
7.5 No refunds. Credit is non-refundable and can't be exchanged for cash or transferred to another business.
7.6 Expiry. Each purchase of credit expires 12 months after the date you buy it. Credit is used oldest first. Any credit left after its expiry date is lost.
7.7 Closing or suspending accounts. We may suspend or close an account if these terms are breached. If we close your account for a reason that isn't your fault, we'll refund any unexpired credit.
8. Site rules, safety and liability
8.1 Site rules. Everyone visiting under a booking must:
- wear hi-vis clothing and safety boots whenever outside the vehicle;
- keep to the 10 mph speed limit and follow all signs and staff directions;
- stay in the cab unless staff say otherwise;
- keep passengers in the vehicle, and bring no children or animals;
- switch engines off while waiting;
- not smoke or vape anywhere on the Site;
- use the wheel wash when leaving; and
- report any accident, spill or near miss to staff immediately.
8.2 Stopping a visit. We may refuse entry, or stop a visit at any time, for safety or compliance reasons or if these terms are breached.
8.3 Your responsibilities. You are responsible for your vehicle, driver and Load, and for complying with the law that applies to them, including your duty of care for waste. You must hold motor insurance, public liability insurance and employers' liability insurance suitable for your activities on the Site.
8.4 Your liability to us. You will cover our losses, costs and liabilities, including fines, clean-up costs and third-party claims, that arise from:
- Non-conforming or hazardous waste in your Load;
- inaccurate information in your booking or Transfer Note;
- your breach of these terms; or
- your negligence, or that of your drivers, on the Site.
8.5 Our liability to you. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law doesn't allow us to limit. Otherwise:
- we aren't liable for indirect or consequential loss, or for loss of profit, business or time, including delays at the Site; and
- our total liability for any booking is limited to the amount you paid us for that booking.
8.6 Damage to vehicles. We aren't responsible for damage to your vehicle, or its contents, caused by the Load, the tipping operation, or the ordinary condition of a working waste site, except where caused by our negligence.
9. General
9.1 Refusing service. We may refuse or cancel bookings from, and refuse entry to, any business, driver or vehicle that:
- has breached these terms;
- has an unpaid invoice;
- has refused to pay for a Load;
- has brought hazardous or Non-conforming Waste to the Site; or
- has behaved unsafely or abusively towards our staff.
We may block future bookings by company name, carrier registration or vehicle registration. We may report suspected illegal waste activity to the Environment Agency or the police.
9.2 Your data. We use the information you give us to take and manage bookings, check carrier registrations, keep the waste records the law requires, take payment and issue invoices. The Site uses CCTV. Our privacy policy explains how we handle personal data.
9.3 Events outside our control. We aren't liable for delays or failures caused by events outside our reasonable control, such as severe weather, fire, equipment failure, utility outages or regulatory action.
9.4 Changes to these terms. We may update these terms. The version on our website when you make a booking applies to that booking.
9.5 Other terms. If any part of these terms is found unenforceable, the rest still applies. If we don't enforce a term straight away, we can still enforce it later.
9.6 Governing law. These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
